Terms of Service Agreement

1. OVERVIEW

This Terms of Service Agreement (this “Agreement”) is entered into by and between BongHosting (operated at bonghosting.com) and “You”, and is made effective as of the date of your electronic acceptance. This Agreement sets forth the general terms and conditions of your use of BongHosting’s services (“Services”) purchased or accessed through the BongHosting website (bonghosting.com), and is in addition to (not in lieu of) any specific terms and conditions that apply to the particular services you purchase or access through BongHosting.

Your electronic acceptance of this Agreement signifies that you have read, understood, acknowledged, and agreed to be bound by this Agreement, along with the following policies and agreements, which are incorporated herein by reference:

  • Privacy Policy
  • Acceptable Use Policy
  • Backup Policy
  • Refund Policy

The terms “we”, “us”, or “our” shall refer to BongHosting. The terms “you”, “your”, “User”, “Subscriber”, or “Customer” shall refer to any individual or entity who accepts this Agreement. Other terms should be interpreted as per the definitions under the Information Technology Act, 2000 and otherwise as per the general dictionary meaning. Nothing in this Agreement shall be deemed to confer any third-party rights or benefits.

BongHosting, in its sole and absolute discretion, may change or modify this Agreement, and any policies or agreements incorporated herein, at any time. Such changes or modifications shall be effective immediately upon posting to this Site. You acknowledge and agree that:

  1. BongHosting may notify you of such changes or modifications by posting them to bonghosting.com.
  2. Your use of this Site or the Services found at this Site after such changes or modifications have been made (as indicated by the “Last Revised” date at the top of this Agreement) shall constitute your acceptance of this Agreement as last revised.

If you do not agree to be bound by this Agreement as last revised, do not use (or continue to use) this Site or the Services found at this Site.

2. ELIGIBILITY AND AUTHORITY

This Site and the Services found at this Site are available only to users who can form legally binding contracts under applicable law. By using this Site or the Services found at this Site, you represent and warrant that you are:

  1. At least 18 years of age; and/or
  2. Otherwise recognized as being able to form legally binding contracts under applicable law.

If you are entering into this Agreement on behalf of a corporate entity, you represent and warrant that you have the legal authority to bind such corporate entity to the terms and conditions contained in this Agreement. In that case, the terms “you”, “your”, “User”, or “Customer” shall refer to such corporate entity.

If, after your electronic acceptance of this Agreement, BongHosting finds that you do not have the legal authority to bind such corporate entity, you will be personally responsible for the obligations contained in this Agreement, including but not limited to payment obligations.

BongHosting shall not be liable for any loss or damage resulting from BongHosting’s reliance on any instruction, notice, document, or communication reasonably believed by BongHosting to be genuine and originating from an authorized representative of your corporate entity. If there is reasonable doubt about the authenticity of any such instruction, notice, document, or communication, BongHosting reserves the right (but undertakes no duty) to require additional authentication from you.

3. ACCOUNTS

3.1 Account Creation and Accuracy

In order to access some features of this Site or use some of the Services found at this Site, you will have to create an account. You represent and warrant to BongHosting that:

  • All information you submit when creating your account is accurate, current, and complete.
  • You will keep your account information accurate, current, and complete at all times.
  • You will update your contact details within seven (7) days of any change, including your full name, postal address, email address, voice telephone number, and fax number if available.

If BongHosting has reason to believe that your account information is untrue, inaccurate, out-of-date, or incomplete, BongHosting reserves the right, in its sole and absolute discretion, to suspend or terminate your account.

3.2 Account Security

You are solely responsible for all activity that occurs on your account, whether authorized by you or not. You must:

  • Keep your account credentials (login, password, and payment methods) secure at all times.
  • Change your password at least once every six (6) months as a security best practice.
  • Immediately notify BongHosting of any breach of security or unauthorized use of your account by contacting us at admin@bonghosting.com.

BongHosting will not be liable for any loss you may incur due to any unauthorized use of your account. You, however, may be liable for any loss incurred by BongHosting or any third party caused by unauthorized use of your account.

3.3 Inaccurate Information and Material Breach

A Registered Name Holder’s willful provision of inaccurate or unreliable information, willful failure to update information within seven (7) days of any change, or failure to respond for over fifteen (15) days to inquiries by BongHosting concerning the accuracy of contact details shall constitute a material breach of this Agreement and be a basis for suspension and/or cancellation of services.

3.4 Domain Name Licensing

Any Registered Name Holder that intends to license use of a domain name to a third party is nonetheless the Registered Name Holder of record and is responsible for:

  • Providing its own full contact information.
  • Providing and updating accurate technical and administrative contact information adequate to facilitate timely resolution of any problems that arise in connection with the Registered Name.

A Registered Name Holder licensing use of a Registered Name shall accept liability for harm caused by wrongful use of the Registered Name, unless it discloses the current contact information provided by the licensee and the identity of the licensee within seven (7) days to a party providing the Registered Name Holder reasonable evidence of actionable harm.

3.5 Intellectual Property Representation

The Registered Name Holder shall represent that, to the best of their knowledge and belief, neither the registration of the Registered Name nor the manner in which it is directly or indirectly used infringes the legal rights of any third party.

3.6 Dispute Jurisdiction

For the adjudication of disputes concerning or arising from use of the Registered Name, the Registered Name Holder shall submit, without prejudice to other potentially applicable jurisdictions, to the jurisdiction of the courts:

  1. Of the Registered Name Holder’s domicile; and
  2. Where BongHosting is located.

3.7 Suspension and Cancellation

The Registered Name Holder agrees that its registration of the Registered Name shall be subject to suspension, cancellation, or transfer pursuant to any applicable Specification or Policy to:

  1. Correct mistakes by BongHosting or the Registry Operator in registering the name; or
  2. Resolve disputes concerning the Registered Name.

3.8 Indemnification of Registry

The Registered Name Holder shall indemnify and hold harmless the Registry Operator and its directors, officers, employees, and agents from and against any and all claims, damages, liabilities, costs, and expenses (including reasonable legal fees and expenses) arising out of or related to the Registered Name Holder’s domain name registration.

3.9 Hosting License Restrictions

Except for Reseller Hosting, VPS Hosting, and Dedicated Servers, all other services are under an individual license where the contract is between the Registered Name Holder and BongHosting. The Registered Name Holder is not authorized to sell, resell, or sub-license hosting space to any third-party clients. To do so, the Registered Name Holder must have one of the following services active:

  • Reseller Hosting
  • VPS Hosting
  • Dedicated Servers

4. RULES OF CONDUCT

You agree not to host, display, upload, modify, publish, transmit, update, or share any information that:

  1. Belongs to another person and to which you do not have any right, unless you have written consent from the owner of the copyrighted material.
  2. Is grossly harmful, harassing, blasphemous, defamatory, obscene, paedophilic, libellous, invasive of another’s privacy, hateful, or racially or ethnically objectionable, disparaging, relating to or encouraging money laundering or gambling, or otherwise unlawful in any manner whatsoever.
  3. Harms minors in any way.
  4. Infringes any patent, trademark, copyright, or other proprietary rights.
  5. Violates any law for the time being in force.
  6. Deceives or misleads the addressee about the origin of such messages or communicates any information which is grossly offensive or menacing in nature.
  7. Impersonates another person.
  8. Contains software viruses or any other computer code, files, or programs designed to interrupt, destroy, or limit the functionality of any computer resource.
  9. Threatens the unity, integrity, defence, security, or sovereignty of India, friendly relations with foreign states, or public order, or causes incitement to the commission of any cognisable offence, or prevents investigation of any offence, or is insulting to any other nation.

4.1 General Conduct

You further acknowledge and agree that:

  • Your use of this Site and the Services found at this Site, including any content you submit, will comply with this Agreement and all applicable local, state, national, and international laws, rules, and regulations.
  • You will not collect or harvest (or permit anyone else to collect or harvest) any user content or any non-public or personally identifiable information about another user or any other person or entity without their express prior written consent.
  • You will not use this Site or the Services found at this Site in a manner that:
    • Is illegal, or promotes or encourages illegal activity;
    • Promotes, encourages, or engages in child pornography or the exploitation of children;
    • Promotes, encourages, or engages in hate speech, hate crime, terrorism, or violence against people, animals, or property;
    • Promotes, encourages, or engages in any spam or other unsolicited bulk email, or computer or network hacking or cracking;
    • Violates the privacy or publicity rights of another user or any other person or entity;
    • Interferes with the operation of this Site or the Services found at this Site;
    • Contains false or deceptive language, or unsubstantiated or comparative claims, regarding BongHosting or BongHosting’s Services.
  • You agree to back up all of your User Content so that you can access and use it when needed. BongHosting does not warrant that it backs up any Account or User Content, and you agree to accept as a risk the loss of any and all of your User Content.
  • You will not use this Site or the Services found at this Site for any commercial use without BongHosting’s express prior written consent.

BongHosting reserves the right to modify, change, or discontinue any aspect of this Site or the Services found at this Site, including without limitation prices and fees for the same, at any time.

5. CONTENT MONITORING AND ACCOUNT TERMINATION

BongHosting generally does not pre-screen User Content (whether posted to a website hosted by BongHosting or posted to this Site). However, BongHosting reserves the right (but undertakes no duty) to do so and to decide whether any item of User Content is appropriate and/or complies with this Agreement.

BongHosting may:

  • Remove any item of User Content that violates this Agreement.
  • Terminate a User’s access to this Site or the Services found at this Site for posting or publishing any material in violation of this Agreement, or for otherwise violating this Agreement (as determined by BongHosting in its sole and absolute discretion), at any time and without prior notice.
  • Terminate a User’s access if BongHosting has reason to believe the User is a repeat offender.

If BongHosting terminates your access to this Site or the Services found at this Site, BongHosting may, in its sole and absolute discretion, remove and destroy any data and files stored by you on its servers.

6. RESERVATION OF RIGHTS

BongHosting expressly reserves the right to deny, cancel, terminate, suspend, lock, or modify access to (or control of) any Account or Services (including the right to cancel or transfer any domain name registration) for any reason, including but not limited to the following:

  1. To correct mistakes made by BongHosting in offering or delivering any Services (including any domain name registration).
  2. To protect the integrity and stability of, and correct mistakes made by, any domain name registry.
  3. To assist with fraud and abuse detection and prevention efforts.
  4. To comply with applicable local, state, national, and international laws, rules, and regulations.
  5. To comply with requests of law enforcement, including subpoena requests.
  6. To comply with any dispute resolution process.
  7. To defend any legal action or threatened legal action.
  8. To avoid any civil or criminal liability on the part of BongHosting, its officers, directors, employees, and agents, as well as BongHosting’s affiliates.

BongHosting expressly reserves the right to review every account for excessive space and bandwidth utilization, and to terminate or apply additional fees to those accounts that exceed allowed levels.

7. NO SPAM POLICY

Sending unsolicited bulk and/or commercial messages over the Internet (known as “spamming”) is strictly prohibited. Spamming is not only harmful because of its negative impact on consumer attitudes toward BongHosting, but also because it can overload BongHosting’s network and disrupt service to BongHosting’s subscribers.

Maintaining an open SMTP relay is strictly prohibited.

BongHosting reserves the right to immediately suspend or terminate any account found to be engaging in spamming activities, without prior notice or refund.

8. SERVICE LEVEL AGREEMENT (SLA)

BongHosting is committed to providing a standard of excellence commensurate with the best practices in the web hosting industry.

BongHosting aims to achieve 99% Service Availability of its Services for all customers. In case of failure to meet the guaranteed level of hosting service, you will be eligible to receive Service Credits as described below, calculated on the basis of the monthly service charge for the affected Services:

8.1 SLA Exclusions

Customers shall not receive any credits under this SLA in connection with any failure or deficiency of Service Availability caused by or associated with:

  • Circumstances beyond BongHosting’s reasonable control, including acts of any governmental body, war, insurrection, sabotage, armed conflict, embargo, fire, flood, strike or other labour disturbance, interruption of or delay in transportation, unavailability of or interruption or delay in telecommunications or third-party services, failure of third-party software.
  • Attacks by viruses or hackers, including Distributed Denial of Service (DDoS) attacks against BongHosting’s network.
  • Scheduled maintenance and system upgrades, or emergency maintenance.
  • Any DNS or Domain Name Registry issues outside the direct control of BongHosting, including DNS and Registry propagation issues and expiration.
  • Customer’s acts or omissions, including custom scripting or coding, negligence, wilful misconduct, or use of the Customer’s account in breach of BongHosting’s Terms of Service and Acceptable Use Policy.
  • Issues with third-party email systems, including refusal or rejection of email by third-party mail systems.
  • Delays in email delivery.
  • False SLA breaches reported as a result of outages or errors of any BongHosting measurement system.
  • Outages elsewhere on the Internet that hinder access to your account.

8.2 Credit Request Process

To receive a credit, you must make a request by sending an email to admin@bonghosting.com. Each request must include: Customer Name, Username, Domain, and Date/Time of the unavailability.

Credit requests must be received by BongHosting within 30 working days from the time of unavailability of the relevant Service. If the unavailability is confirmed by BongHosting, credits will be applied within 30 days of BongHosting’s receipt of the Customer’s credit request.

Note: The total amount credited to a Customer in a particular month under this SLA shall not exceed the total hosting fee paid by the Customer for such month for the affected Service(s). Credits are not refundable and can be used only towards future billing charges.

9. BACKUP POLICY

9.1 BongHosting Backups

BongHosting may maintain system backups of servers hosting client data and applications, retained for a minimum of one (1) month from the date of their creation. However, BongHosting does not guarantee the availability of backups at all times and cannot be held responsible for loss of data under any circumstances.

9.2 Customer Responsibility

You, as a BongHosting customer, are solely responsible for maintaining your own backups of all data, files, emails, and databases hosted on BongHosting servers. BongHosting strongly recommends that you:

  • Regularly back up all your data to an external storage location.
  • Verify the integrity of your backups periodically.
  • Download a copy of your data before cancelling or modifying your service.

BongHosting shall not be held responsible for loss of data, corruption of data, or any damage resulting from failure to maintain adequate backups, whether caused by hardware failure, software error, human error, or any other cause.

9.3 Backup Requests

While BongHosting may attempt to restore data from available backups on a best-effort basis, BongHosting makes no warranty that such restoration will be successful or complete. Any backup restoration services provided by BongHosting may be subject to additional fees.

10. TRADEMARK AND COPYRIGHT CLAIMS

BongHosting supports the protection of intellectual property. In connection with such protection:

  1. Customers shall ensure that by availing of any website services, they are not infringing upon any intellectual property rights or other rights of any person or entity, and do not publish any content that is illegal while using services under this Agreement.
  2. Customers acknowledge that BongHosting cannot and does not check whether any services or the use of services by the Customer under this Agreement infringe the legal rights of others.
  3. Unless specifically permitted to do so or covered by a separate agreement, you agree that you will not use any trademark, service mark, trade name, or logo of any company or organization in a way that is likely or intended to cause confusion about the owner or authorized user of such marks, names, or logos.
  4. In case of any notice received under DMCA or otherwise for intellectual property violation, BongHosting reserves the right to remove the content with or without issuing prior notice to the Customer, depending upon the seriousness of the matter.

11. LINKS TO THIRD-PARTY WEBSITES

This Site and the Services found at this Site may contain links to third-party websites that are not owned or controlled by BongHosting. BongHosting:

  • Assumes no responsibility for the content, terms and conditions, privacy policies, or practices of any third-party websites.
  • Does not censor or edit the content of any third-party websites.

By using this Site or the Services found at this Site, you expressly release BongHosting from any and all liability arising from your use of any third-party website. BongHosting encourages you to review the terms and conditions, privacy policies, and other governing documents of each website you may visit.

12. DISCLAIMER OF REPRESENTATIONS AND WARRANTIES

YOU SPECIFICALLY ACKNOWLEDGE AND AGREE THAT YOUR USE OF THIS SITE AND THE SERVICES FOUND AT THIS SITE SHALL BE AT YOUR OWN RISK AND THAT THIS SITE AND THE SERVICES FOUND AT THIS SITE ARE PROVIDED “AS IS”, “AS AVAILABLE”, AND “WITH ALL FAULTS”.

BONGHOSTING, ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS DISCLAIM ALL WARRANTIES, STATUTORY, EXPRESS, OR IMPLIED, INCLUDING BUT NOT LIMITED TO ANY IMPLIED WARRANTIES OF TITLE, MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

BONGHOSTING, ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS MAKE NO REPRESENTATIONS OR WARRANTIES ABOUT:

  1. THE ACCURACY, COMPLETENESS, OR CONTENT OF THIS SITE;
  2. THE ACCURACY, COMPLETENESS, OR CONTENT OF ANY SITES LINKED TO THIS SITE; AND/OR
  3. THE SERVICES FOUND AT THIS SITE OR ANY SITES LINKED TO THIS SITE.

NO ORAL OR WRITTEN INFORMATION OR ADVICE PROVIDED BY BONGHOSTING, ITS OFFICERS, DIRECTORS, EMPLOYEES, OR AGENTS WILL:

  1. CONSTITUTE LEGAL OR FINANCIAL ADVICE; OR
  2. CREATE A WARRANTY OF ANY KIND WITH RESPECT TO THIS SITE OR THE SERVICES FOUND AT THIS SITE.

THE FOREGOING DISCLAIMER OF REPRESENTATIONS AND WARRANTIES SHALL APPLY TO THE FULLEST EXTENT PERMITTED BY LAW AND SHALL SURVIVE ANY TERMINATION OR EXPIRATION OF THIS AGREEMENT OR YOUR USE OF THIS SITE OR THE SERVICES FOUND AT THIS SITE.

13. LIMITATION OF LIABILITY

IN NO EVENT SHALL BONGHOSTING, ITS OFFICERS, DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE TO YOU OR ANY OTHER PERSON OR ENTITY FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, PUNITIVE, OR CONSEQUENTIAL DAMAGES WHATSOEVER, INCLUDING ANY THAT MAY RESULT FROM:

  1. THE ACCURACY, COMPLETENESS, OR CONTENT OF THIS SITE;
  2. THE ACCURACY, COMPLETENESS, OR CONTENT OF ANY SITES LINKED TO THIS SITE;
  3. THE SERVICES FOUND AT THIS SITE OR ANY SITES LINKED TO THIS SITE;
  4. PERSONAL INJURY OR PROPERTY DAMAGE OF ANY NATURE WHATSOEVER;
  5. THIRD-PARTY CONDUCT OF ANY NATURE WHATSOEVER;
  6. ANY UNAUTHORIZED ACCESS TO OR USE OF OUR SERVERS AND/OR ANY CONTENT, PERSONAL INFORMATION, FINANCIAL INFORMATION, OR OTHER INFORMATION AND DATA STORED THEREIN;
  7. ANY INTERRUPTION OR CESSATION OF SERVICES TO OR FROM THIS SITE OR ANY SITES LINKED TO THIS SITE;
  8. ANY VIRUSES, WORMS, BUGS, TROJAN HORSES, OR THE LIKE, WHICH MAY BE TRANSMITTED TO OR FROM THIS SITE OR ANY SITES LINKED TO THIS SITE;
  9. ANY USER CONTENT OR CONTENT THAT IS DEFAMATORY, HARASSING, ABUSIVE, HARMFUL TO MINORS OR ANY PROTECTED CLASS, PORNOGRAPHIC, OBSCENE, OR OTHERWISE OBJECTIONABLE; AND/OR
  10. ANY LOSS OR DAMAGE OF ANY KIND INCURRED AS A RESULT OF YOUR USE OF THIS SITE OR THE SERVICES FOUND AT THIS SITE, WHETHER BASED ON WARRANTY, CONTRACT, TORT, OR ANY OTHER LEGAL OR EQUITABLE THEORY, AND WHETHER OR NOT BONGHOSTING IS ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

YOU SPECIFICALLY ACKNOWLEDGE AND AGREE THAT:

  • Any cause of action arising out of or related to this Site or the Services found at this Site must be commenced within one (1) year after the cause of action accrues, otherwise such cause of action shall be permanently barred.
  • In no event shall BongHosting’s total aggregate liability exceed the total amount paid by you for the particular Services that are the subject of the cause of action.

THE FOREGOING LIMITATION OF LIABILITY SHALL APPLY TO THE FULLEST EXTENT PERMITTED BY LAW AND SHALL SURVIVE ANY TERMINATION OR EXPIRATION OF THIS AGREEMENT.

14. INDEMNIFICATION

You agree to protect, defend, indemnify, and hold harmless BongHosting and its officers, directors, employees, and agents from and against any and all claims, demands, costs, expenses, losses, liabilities, and damages of every kind and nature (including, without limitation, reasonable attorneys’ fees) imposed upon or incurred by BongHosting directly or indirectly arising from:

  1. Your use of and access to this Site or the Services found at this Site;
  2. Your violation of any provision of this Agreement or the policies or agreements incorporated herein; and/or
  3. Your violation of any third-party right, including without limitation any intellectual property or other proprietary right.

The indemnification obligations under this section shall survive any termination or expiration of this Agreement or your use of this Site or the Services found at this Site.

15. FORCE MAJEURE

Either party to this Agreement shall be excused from any delay or failure in performance caused by reason of any occurrence or contingency beyond its reasonable control, including but not limited to:

  • Acts of God, earthquake, floods, or other natural disasters;
  • Labor disputes and strikes, riots, or war;
  • Governmental requirements or regulations;
  • Power failures or telecommunications outages;
  • DDoS attacks or other large-scale cyberattacks beyond reasonable control.

The obligations and rights of the party so excused shall be extended on a day-to-day basis for the period of time equal to that of the underlying cause of the delay.

16. FEES, PAYMENTS, AND RENEWALS

16.1 Payment Obligation

You agree to pay all applicable fees for Services in effect at the time of sign-up, registration, and/or renewal, subject to these Terms. You agree to update and keep current all billing information, email, and other contact information. It is your responsibility to verify that the information submitted is accurate to ensure proper billing and continuity of services.

16.2 Automatic Renewal — Hosting Account

As a courtesy and not as an obligation, fifteen (15) days prior to the expiration of your Hosting Account, BongHosting will automatically attempt to renew your Hosting Account for the same duration initially selected, at the then-current, non-promotional rate, by charging the applicable fee to your current method of payment on file.

16.3 Automatic Renewal — Domain Names

As a courtesy and not as an obligation, fifteen (15) days prior to the expiration of your domain registered with BongHosting, BongHosting will automatically attempt to renew your domain by charging the applicable fee to your current method of payment on file.

You acknowledge and confirm that the obligation to renew your domain(s) is solely and exclusively your responsibility. BongHosting is hereby released from any and all liability for failure to renew any Account or Domain(s) for any reason, including but not limited to:

  • Inability to bill renewal to your method of payment on file;
  • Inability to contact you at the email address on file; or
  • Any other technical or operational reason.

In the event that a Domain expires, BongHosting will hold the expired Domain for up to 3 days as a courtesy. After 3 days, the Domain will be placed in Redemption. During the Redemption period, the Domain will be inaccessible and unable to be registered elsewhere. To bring a Domain out of Redemption, you must pay a Redemption Fee plus a Renewal Fee for the current year.

16.4 Cancellation of Automatic Renewal

You agree to notify BongHosting of your intent to cancel automatic renewal at least sixteen (16) business days prior to the account or domain expiration date, by contacting us at:

This request must include verification of ownership of the hosting account and/or domain(s) as determined by BongHosting.

16.5 Account Data After Expiry

Your hosting account and data will not be available upon failure to renew the service on time. The system will automatically delete your data if you fail to renew on time. BongHosting strongly recommends downloading a complete backup of your data before your account expires.

16.6 Cancellations After 30 Days

You may cancel your Services at any time. However, there will be no refund given for the amount already paid after the 30-day money-back guarantee period has elapsed.

16.7 Notice of Cancellation

All cancellation requests must be directed to BongHosting via email at admin@bonghosting.com. The cancellation request must include:

  • Verification of ownership of the hosting account and/or domain(s).

16.8 45-Day Money-Back Guarantee

BongHosting provides a 45-day unconditional money-back guarantee for web hosting services only. The following payment methods are non-refundable and refunds will be posted as credit to the hosting account:

  • Bank Wire Transfers
  • UPI Payments (where applicable)
  • Any other non-reversible payment methods

There are no refunds on:

  • Domain registration and domain-related services;
  • Administrative fees and installation fees;
  • SSL certificates and other add-on products.

Only first-time accounts are eligible for a refund. If you have previously had an account with BongHosting, cancelled, and signed up again, you will not be eligible for a refund.

17. DOMAIN REGISTRATION

It is the responsibility of the customer to verify whether domain registration is successful. Under unfortunate circumstances, domain registration may fail due to software errors, network errors, invalid/insufficient information provided, late payments received, or other unknown technical reasons.

  • If there is any issue with domain registration, the customer must contact BongHosting within 7 working days by emailing admin@bonghosting.com or calling/WhatsApp 9674962117.
  • Domain registration is subject to availability of the domain name at the time of registration.

BongHosting accepts no liability for the loss of any domain that has failed to register due to invalid or insufficient information provided, late payments, or technical faults beyond our control.

18. DOMAIN RENEWAL

Domain renewal notices are provided as a courtesy reminder, and BongHosting is not responsible for failure to renew a domain or failure to notify a customer about a domain’s renewal.

It is the customer’s sole responsibility to verify that domain renewal is successful. If there is any issue with domain renewal, the customer must contact BongHosting within 7 working days by emailing admin@bonghosting.com or calling/WhatsApp 9674962117.

BongHosting accepts no liability for the loss of registration of any Domain that has failed to be renewed due to:

  • An invalid email address provided to us;
  • Late payments received; or
  • Technical faults which are beyond our control.

19. DOMAIN TRANSFERS

BongHosting cannot be held responsible for any failure of domain or hosting transfer from another service provider. When transferring a domain from another service provider, under some circumstances it may not be technically possible to complete the transfer successfully due to:

  • Wrong EPP/Authorization code;
  • Domain being locked or blocked by the current service provider;
  • Domain being within 60 days of original registration;
  • Any other technical reason.

You understand that it is your responsibility to ensure that the domain is renewed with the other service provider or successfully transferred to BongHosting. BongHosting is not liable for any domain loss occurring during a transfer process.

20. RESOURCE USAGE POLICY

20.1 CPU and Memory Usage

Excessive use of CPU, RAM, or other server resources that affects the performance of shared server environments is prohibited. BongHosting reserves the right to:

  • Suspend or terminate accounts that excessively consume server resources;
  • Charge additional fees for excessive resource usage; or
  • Upgrade your account to a more appropriate hosting plan.

20.2 Inode Limits

The total number of inodes (files and folders) that can be used by a customer is based on the hosting plan you have chosen and paid for.

20.3 Bandwidth Usage

Your account is entitled to the bandwidth allocation specified in your hosting plan. BongHosting reserves the right to suspend accounts that exceed their allotted bandwidth until the next billing cycle or upon payment of applicable overage charges.

21. EMAIL USAGE POLICY

  • You may not send unsolicited bulk email (spam) from BongHosting servers.
  • Maintaining an open mail relay is strictly prohibited.
  • You agree not to use BongHosting’s email services for phishing, fraud, or any other illegal activities.
  • BongHosting reserves the right to impose limits on the number of outgoing emails per hour/day to prevent abuse.
  • Mass mailing campaigns must comply with applicable laws, including CAN-SPAM Act requirements and India’s Information Technology Act, 2000.

22. NO THIRD-PARTY BENEFICIARIES

Nothing in this Agreement shall be deemed to confer any third-party rights or benefits. This Agreement is solely between BongHosting and the Customer.

23. COMPLIANCE WITH LOCAL LAWS

BongHosting makes no representation or warranty that the content available on this Site or the Services found at this Site are appropriate in every country or jurisdiction. Access to this Site or the Services found at this Site from countries or jurisdictions where its content is illegal is prohibited.

Users who choose to access this Site or the Services found at this Site are responsible for compliance with all local laws, rules, and regulations.

24. GOVERNING LAW AND DISPUTE RESOLUTION

  1. This Agreement and the relationship between you and BongHosting shall be governed by the laws of India.
  2. The Courts of law in India shall have exclusive jurisdiction over any disputes arising under this Agreement or other related issues arising out of the use of this Site or related services.
  3. BongHosting’s failure to exercise or enforce any right or provision of this Agreement shall not constitute a waiver of such right or provision.
  4. If any provision of this Agreement is found by a court of competent jurisdiction to be invalid, the parties agree that the court should endeavor to give effect to the parties’ intentions as reflected in the provision, and the other provisions of this Agreement shall remain in full force and effect.
  5. Any claim or cause of action arising out of or related to use of the Services or this Agreement must be filed within one (1) year after such claim or cause of action arose, or be forever barred.

Each covenant and agreement in this Agreement shall be construed for all purposes to be a separate and independent covenant or agreement.

If a court of competent jurisdiction holds any provision (or portion of a provision) of this Agreement to be illegal, invalid, or otherwise unenforceable, the remaining provisions (or portions of provisions) of this Agreement shall not be affected thereby and shall be found to be valid and enforceable to the fullest extent permitted by law.

26. SECURITY RESPONSIBILITIES

BongHosting takes the security of its infrastructure seriously. However:

  • You are responsible for maintaining the security of your own applications, scripts, and software installed on your hosting account.
  • You must promptly update any outdated software, CMS platforms (e.g., WordPress, Joomla), plugins, and themes to their latest stable versions.
  • BongHosting reserves the right to suspend accounts that are found to be compromised and are being used to harm other customers or systems.
  • BongHosting is not responsible for any data breach, unauthorized access, or data loss arising from vulnerabilities in your applications or software.

27. PRIVACY AND DATA PROTECTION
